Guard: Larry Birkhead posed at Anna Nicole’s son’s grave

A decorated former deputy with the L.A. Sheriff’s Dept. who worked as a bodyguard for Larry Birkhead claims that the father of the late Anna Nicole Smith’s baby Dannielynn fake-posed at the grave of her son Daniel.

Mark Speer said he was guarding Birkhead in the Bahamas when Birkhead called Splash News, a paparazzi and tabloid news agency.

Speer, 53, told us: “Larry and I went to Nassau for over a week in January of this year. One day he said he wanted to go to Daniel’s grave, ostensibly to pay tribute to him on his birthday. But it turned out he had another idea. He said, ‘We’re going to meet two guys from Splash.’

“They had arranged to wait in some bushes at the cemetery. They took pictures of Larry pretending to be sad and emotional at the grave site. Only the Splash guys weren’t quite satisfied, so they asked him to do it again, and for me to get out of the picture. We did three takes. That was the first sign to me that Larry was in it for the money.” When police were investigating Daniel’s death, Speer says, “I was in the room when he gave the police a statement.” He claims that Birkhead alleged to authorities that Smith’s attorney Howard K. Stern “was wiring money from Anna’s estate to offshore accounts and that he’d forged her signature.” Birkhead also claimed he’d “watched Howard giving [Smith] drugs,” Speer says.

Speer adds, “I was with Larry when he went to meet Howard at the Horizon mansion [in the Bahamas]. It was a secret meeting, where he got to see Dannielynn. … I heard Howard tell Larry that he’d give him custody of the baby if he [would allow] Stern to remain as executor of the estate. Larry said, ‘I’ll think about it.’

“At one point, the baby burped up some fluid on a blanket. Howard said, ‘I bet you’d like to have that for DNA.’?” Even more shocking is a trip Speer says he took with Birkhead on a private jet belonging to a wealthy friend of Smith’s. The friend’s wife “pulled out a stack of photographs,” Speer recalls. “They were pictures of Anna and the baby … in a hospital bed with her son Daniel. Daniel appeared to be dead. [The friend] told me he was dead.”

Stern’s attorney L. Lin Wood did not answer e-mailed questions by deadline; Birkhead did not return our call.

An explosive tell-all book about Anna Nicole Smith’s sad demise alleges the two men who battled for custody of her baby girl and control of her fortune were gay lovers.

The bombshell allegations about the steamy relationship between the former Playboy Playmate’s longtime companion Howard K. Stern and her baby’s biological father, Larry Birkhead, come to light in “Blonde Ambition: The Untold Story Behind Anna Nicole Smith’s Death.”

Sordid passages in the soon-to-be released book by former MSNBC journalist Rita Cosby describe how Anna Nicole and her friend allegedly caught Stern and Birkhead with their shirts off and their pants around their ankles in a Los Angeles home.

Jackie Hatten, described in the book as one of Anna Nicole’s closest friends, said the men were engaged in oral sex.

“Their bodies were intermingled,” Hatten says, according to a copy of the book obtained by the Daily News. “It was obvious what was happening.”

The shocking book accuses Birkhead and Stern of cutting a secret deal after Anna Nicole was buried in March, with Birkhead getting custody of Dannielynn in return for Stern being named executor of the star’s estate.

Dannielynn, who turns 1 on Friday, could inherit hundreds of millions of dollars from the estate of Smith’s late husband, oil tycoon Howard Marshall.

Birkhead and a lawyer for Stern both vehemently denied the accusations in Cosby’s book yesterday – and vowed to drag her into court, setting the stage for an ugly legal battle.

“None of it is true,” Birkhead told The News. “I’m gonna sue Rita Cosby for it.”

Birkhead said he was disgusted by Cosby’s claim that he and Stern were gay lovers.

“If she printed that then she is really getting sued,” Birkhead yelled. “My attorneys are going after her and that is absolutely false. And I am sure Howard and the estate and everyone else involved is going to sue her too. This is just nonsense.”

Stern’s lawyer, Lin Wood, called the book’s content “false and defamatory.” Wood said Cosby “has taken the coverage to a disgusting new low for which she will be held legally accountable.”

OK! magazine already has severed ties with Birkhead over the Cosby allegations, axing coverage of Dannielynn’s first birthday as the final part of a $1.7 million access deal.

The 244-page book reads like a whodunit novel with cliffhanger chapters, plot twists and tales of deception by those closest to Anna Nicole.

The former stripper knew both Birkhead and Stern were gay, the book alleges. But Smith, who was obsessed with Marilyn Monroe, chose Birkhead as her lover because she wanted a blond, blue-eyed baby, according to Cosby.

The tell-all claims Anna Nicole would spread out on her bed and watch a video allegedly showing Birkhead and Stern having oral sex “over and over” while Stern worked on his computer in their Bahamas home. The existence of the video was confirmed by a source yesterday.

Stern is portrayed in Cosby’s book as a jealous, money-grabbing control freak who manipulates the erratic blond beauty’s celebrity status for his own financial gain.

As her life spun out of control after the death of her son, Daniel, last September, Stern kept Anna Nicole hidden from friends and forced the heavily drugged model to sign stacks of paperwork, the book claims.

His alleged “goodie bag” of meds – including Vicodin, Valium, morphine and Demerol – were never far from reach.

“He was the pharmacist and [the bag] was the drugstore,” Anna Nicole’s ex-boyfriend Ben Thompson told Cosby.

In Anna Nicole’s final days, the buxom blond was holed up in Room 607 at the Hard Rock Hotel in Florida, with a raging 105-degree fever, the book says.

She was watched by Stern, her bodyguard, her psychiatrist and a handful of aides as a pus-filled abscess from a needle injection in her left buttock caused an infection in her bloodstream, Cosby writes.

Cosby alleges a right-handed Anna Nicole could never have administered these injections herself.

As Anna Nicole’s life slowly ebbed away, Stern allegedly abandoned her to keep an appointment with a boat broker. The book describes him as cold and nonchalant when told of Anna Nicole’s death – a far cry from the picture of a doting lover he painted in interviews.

As doctors rushed Anna Nicole to a hospital in a futile bid to save her life, Stern allegedly was already on the phone to media contacts lining up lucrative exclusive interviews.

“Howard was ready to make his next deal,” an eyewitness says in the book. “It showed us that to Howard it was all about money.”

Birkhead comes across as no angel either. The book claims Birkhead gave Smith cocktails of drugs and watched as Stern allegedly gave medication to Anna Nicole while she was attached to an IV drip in the hospital during her pregnancy.

His image as the “aw shucks nice guy” was a carefully crafted ploy to manipulate the media, Birkhead’s former lawyer Debra Opri told Cosby. Opri is suing Birkhead for failing to pay her legal fees.

Yesterday, Birkhead dismissed Cosby, whose MSNBC show was canceled last year, as a has-been TV hack.

“She got fired and nobody wanted her,” Birkhead told The News. “The last story she did was on Anna and now she is doing this book because no one will hire her.”

Stern’s lawyer was equally outraged, saying: “It appears that Ms. Cosby has joined the ranks of tabloid journalists who are willing to publish the print equivalent of sewerage to engage in character assassination for profit.”

Daniel was like a son to Howard and Dannielynn was his daughter. He loses the three most important people in his life less than a year but most don’t care.

Larry only sued for custody after Daniel died. And he tells Anna days after Daniel died that she’ll rot in the pitts of hell. While Howard looks like he’s had the blood and life drained out of him.

While Larry was in the Bahamas while still fighting it out with Howard, he’s partying in clubs in the. Can you imagine the media scrutiny if Howard was clubbing and trying to pick up women during all of that?

BTW, Howard bought Larry a Father’s Day gift.

It will be a poignant first Father’s Day for Dannielynn, the first one with her new Dad, Larry Birkhead, who’s busy fixing up the Studio City house, new paint, new carpets, baby-proofing, to raise his little girl the way Anna would have wanted, friends tell me, …and the first time Anna Nicole hasn’t played Dad for her children on Father’s Day.

“Anna saw herself as both mother and father to Daniel,” Howard K. Stern is telling me in an emotional late night call from the Bahamas, before taking off to spend Sunday with his own father and family in California. “Everyone used to get her cards and presents and flowers. Just like we did on Mother’s Day. ”

Her favorites were lilies, Stargazers and pink roses, he’s saying. And before he flew home to also meet with probate lawyers for the June 19 hearing that’s expected to name Stern executor and Birkhead guardian of the estate, Stern made a private visit to the Bahamas cemetery to leave flowers on Anna’s grave, next to her late son, Daniel, the same flowers they used to pick out for Anna together.

“Daniel gave her a painting he’d done on the last Father’s Day they spent together,” says Stern. “He spent the day with his mother, and it was really special to her. The family was there, even Larry (Birkhead) came by.”

Nowadays, Stern usually visits Anna and Daniel alone, at odd hours, to avoid paparazzi on Horizons’ watch, so he can weep privately for the woman he loved and managed for almost 11 years, whose career he helped turn around, and the quiet, blond-haired boy he mentored who, friends tell me, looked up to Stern as a father figure.

“I loved Daniel,” he says. “We spent a lot of time together. I watched him grow up…Anyone who knows how we were knows that. It’s sickening to hear what some people who don’t know what happened are saying. But the truth will come out.”

“If Daniel wanted to go to the movies or to get food, Howard went with him,” says his sister, Bonnie Stern in Los Angeles. “Howard took him to buy clothes or video games, just normal things a Dad would do.”

It’s the story few want to hear, says Stern, reluctant to delve into the relentless talk show attacks against him as the “designated bad guy,” or share his private grief in a savage media arena. He’s grown thick skin, he says. “Anna understood it because she rarely got a break in the press,” he says. “She used to say, ‘If I were a nun, they’d accuse me of (sleeping with) the Pope.’”

“The year before last, Daniel spent the day with her and painted her a picture,” he recalls. “Larry was there, too, with the whole family, and we all got her cards because she loved Father’s Day.”

With little or no contact between Daniel and his Texas biodad, Anna took on the role of father and mother, says Stern, for better or worse. Friends believe Daniel’s death was her tipping point.

Over his strained voice, I can hear dogs yapping and growling, as Stern takes a minute to referee the squabble between Sugar Pie, Frankie, Marylin and Puppy, Anna’s beloved dogs. “They’re the only connection I’ve got to her now that Dannielynn is gone,” he says, reluctant to leave them to others to care for while he’s gone. They sleep on the bed with him at night, he says, as they did with Anna, and keep him up fighting to get close. He doesn’t mind.

Stern rarely sleeps, tells me he dozes off in the early morning for a couple of hours, before getting back on the phone with lawyers over issues with the house, the estate, the looming inquest, taking calls from Larry about what’s best for Dannielynn.

He says they are working together to make sure her life is safe and secure, as Anna would have wanted. And he’s hoping he’ll get the only present he really wants–a chance to see and hold Dannielynn one more time. “The only thing better would be for Anna and Daniel to be here.”
